Site Usage Terms & Conditions
These Terms & Conditions ("Terms") govern your access and use of the L'AINE Jobs platform (the "Platform"), which includes our website and mobile applications. By accessing or using the Platform, you agree to be bound by these Terms.
- User Accounts: You may be required to create an account to access certain features of the Platform. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to accept responsibility for all activities that occur under your account.
- User Content: You are solely responsible for any content you upload, post, or share on the Platform ("User Content"). You represent and warrant that you have all rights necessary to share such User Content and that it does not violate any law or the rights of any third party.
- Acceptable Use: You agree to use the Platform only for lawful purposes. You will not: Upload or share any content that is illegal, offensive, discriminatory, or violates any third-party rights. Use the Platform to harm, threaten, or harass others. Interfere with or disrupt the operation of the Platform. Impersonate any person or entity.
- Disclaimers: L'AINE Jobs does not guarantee the accuracy, completeness, or timeliness of the content posted on the Platform. We are not responsible for the content of any external websites linked to from the Platform. We do not guarantee that you will find employment through the Platform.
- Limitation of Liability: L'AINE Jobs is not liable for any damages arising from your use of the Platform, including but not limited to, direct, indirect, incidental, consequential, or punitive damages.
- Termination: We may terminate your access to the Platform at any time and for any reason, with or without notice.
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of Ghana.
- Entire Agreement: These Terms constitute the entire agreement between you and L'AINE Jobs regarding your use of the Platform.
- Changes to the Terms: We may update these Terms at any time. Your continued use of the Platform following the posting of any revised Terms constitutes your acceptance of the revised Terms.

Recruitment Terms & Conditions
THE CLIENT wishes to engage L'AINE for Recruitment Services for its operations in Ghana.

OBLIGATIONS OF L'AINE
- THE CLIENT will liaise with L'AINE to identify the exact nature of the position in terms of qualifications, experience, job description and responsibilities, competencies and other pertinent requirements to determine the appropriate candidate for the required position by sourcing, effective screening and presentation of a shortlist of a minimum of 3 candidates that meet the CLIENT'S needs within a minimum of fifteen (15) to thirty (30) working days depending on the technicality of the role.
- If THE CLIENT does not find a suitable candidate, L'AINE shall provide another set of candidates until THE CLIENT finds the right candidate.
- L'AINE's obligation ends after THE CLIENT has selected a candidate. L'AINE will replace a candidate who resigns from the job within the first three (3) months of employment at no service charge and at a 50% discount of the service charge if a candidate resigns within three (3) to six (6) months of employment.

OBLIGATIONS OF THE CLIENT

L'AINE's service charge for placement of a candidate will depend on the Recruitment Package selected by client.
THE CLIENT has understood that payment of an initial non-refundable sourcing fee, 20% of the proposed salary for the said position is required. This sourcing fee may be deferred based on the business relationship between L'AINE and THE CLIENT. The total service charge or the remainder, if the sourcing fee is not deferred (80% of the total service charge), is to be paid to L'AINE not more than one week on receipt of L'AINE's invoice.
Where the sourcing fee is deferred, THE CLIENT has understood that, in the unlikely event that the recruitment process is cancelled at a point when L'AINE has presented THE CLIENT with suitable candidates for final selection (for reasons as a change in strategic direction or closure of operations etc.), THE CLIENT shall pay L'AINE 20% of the total value of work done (which is pegged at a month's gross salary per candidate).
- The candidate becomes THE CLIENT’s employee after its officials have made a final selection of a preferred candidate, from the shortlist(s) provided by L’AINE, and THE CLIENT has paid L’AINE in full for the recruitment services.
- The CLIENT is obliged to pay the service charge, even if a shortlisted candidate who was previously rejected by the CLIENT is placed within a period of one year from date of submitting the candidate.
- LAINE is responsible for managing the recruitment processes till the candidate is successfully placed. L’AINE shall not be liable for any consequence resulting from direct involvement with candidates.
- L’AINE reserves the right to refer the candidate to another employer should its recruitment charges not be settled in full.

OBLIGATIONS OF BOTH PARTIES
- Any of the two parties may initiate the review or reaffirmation of this Agreement. In the event of it being affected by national policies or future legislations, this Agreement shall be amended or modified accordingly, upon mutual consent of both parties.
- These terms do not affect the contract of employment between the employer (THE CLIENT) and employee selected by THE CLIENT.
- The rights, privileges and obligations of the parties under this Agreement and under any transaction shall not be assigned by either party without the prior written consent of the other party.
- No variation modification or amendment to this Agreement or oral promise or commitment related thereto shall be valid unless it is in writing and signed by duly authorized representatives of the parties.
- No waiver by either Party of any one or more breaches of this Agreement by the other Party shall operate or be construed as a waiver of any future default or defaults by the same Party. Neither Party shall be deemed to have waived, released, or modified any of its rights under this Agreement unless such Party has expressly stated, in writing, that it does waive, release or modify such rights.
- All communications and notices provided for hereunder shall be in writing and shall be personally delivered to the Parties or transmitted by facsimile, e-mail or telephone. Except otherwise specified herein, all notices shall be deemed duly given on the date of receipt, if personally delivered and on the day of transmission as evidenced by the confirmation copy, if transmitted by facsimile or e-mail. Any party may change its address for purposes hereof by written notice to the other party.
- This Agreement shall be governed by and construed in all respects in accordance with the laws of the Republic of Ghana.
- Any dispute, controversy claim or interpretation arising out of or relating to this contract or the breach of this contract, shall be finally settled by arbitration under the auspices and rules in the Ghana Arbitration Centre by one or more arbitrators appointed in accordance with the Rules of the Ghana Arbitration Centre if the 2 parties failed to reach amicable solution by themselves.
